Fencing rules in Cardinia follow a “like for like” system. Fence repairs and replacements “like for like,” which means of similar material, design and quality, don’t require building permits. Otherwise, fences in excess of specified heights require a building permit.

  • More than 1.5 metres if fronting a Council or non-declared road
  • More than 1.8 metres if fronting a VicRoads or declared road*
  • More than 1 metre if within 9 metres of an intersection or corner
  • More than 1.5 metres if made out of lightweight materials (e.g., timber, wire)
  • More than 1.2 metres if made out of heavier materials (e.g., brick, concrete)
  • The first 3 metres of a side fence from the front fence or street is over 1.5 metres
  • Side fences that exceed the max total height of 2 metres
  • Located in properties in Urban Growth Zones
  • Located in properties subject to certain overlays

All fence heights specified are measured from the natural ground level. Any retaining wall is included in the height calculation.

The Cardinia Shire Council doesn’t provide a surveyor for property assessment; instead, it delegates the responsibility to private entities.
