A building permit is necessary for:

  • Pool and spa barrier, regardless of specifications
  • Masonry front or side street fence over 1.2 metres
  • Front fence within 3.0 metres of the front title boundary that’s over 1.5 metres
  • The first 3.0 metres of side fence from the front title boundary that’s over 1.5 metres
  • The rest of the side fence that’s over 2.0 metres
  • Corner fence within 9.0 metres of street alignments that’s over 1.0 metre.

Additionally, you may be asked to file a tree works permit if the fencing project will be close to a significant tree. According to local law, a tree is considered significant if:

  • The single trunk’s circumference or the total circumference of multiple trunks at ground level amounts to 180 cm or more
  • The single trunk’s circumference or the total circumference of multiple trunks at 1.4 metres above ground level amounts to 140 cm or more

Tree works can include cutting down the tree, pruning parts of it, or any work that might disturb the tree’s roots. The last one isn’t unusual in fencing projects, considering some excavation is necessary.
