It proves that the project has been assessed and approved by the surveyor to comply with the local council or shire’s requirements. Long story short, it’s your go-ahead to erect your dream fence.

How do I know if I need a building permit?

Aside from a registered building surveyor, your council or shire or the Victorian Building Authority (VBA) can tell you if your fencing project needs one.

Is applying for a building permit free of charge?

No, the relevant authority will charge a fee for the site assessment and preparation of documents. The cost depends on your local council or shire’s schedule of fees.

I’m not building a house. Why do I need one?

These permits ensure that a project complies with building codes, even if it’s something as simple as installing a fence. By being compliant, the project also ensures the safety of the professionals working on it, which can save you from legal troubles.

What’s the penalty for building without a permit?

Building without a permit is punishable under Section 16 of the Building Act 1993, which carries a hefty fine of 500 penalty units for homeowners and other individuals. Assuming the value of a penalty unit is AUD$197.59 (effective until June 30, 2025), offenders might pay close to AUD$100,000.

Does fencing repair and replacement need a permit?

Maintenance works don’t require a permit, provided the replacement involves individual panels or pickets. Fence replacements, however, require a permit, more so if an entirely new fence design will replace the old one.
